Representatives L. Fite, S. Berry, and Senator Rice have introduced Arkansas House Bill 1234 titled: Arkansas Commerce Tire Program Act
HB1234 would replace the legislation known as the Used Tire Recycling and Accountability Act found at Ark. Code Ann. 8-9-401, et seq.
The existing Arkansas legislation gives the Arkansas Department of Energy & Environment – Division of Environmental Quality (“DEQ’) and the Arkansas Regional Solid Waste Management Districts an extensive role in waste tyre management.
However, over the years the original Act has been amended and updated and this latest proposal will see it replaced, removing much of the day to day management from the State agencies and handing that to commercial operators.
The DEQ would still manage tyre transport licensing and authoriise the administration of permits for tyre processing facilities, tyre collection centres, commercial generators, and any other person collecting, receiving, processing, recycling, or disposing of used tyres.
DEQ enforcement of waste tyre sites and voluntary cleanup options are also included.
